What is demonstrable reasonable diligence?

Reasonable diligence is the standard regulators assess: did you know what AI you ran, find its gaps, address them — and can you prove all of it? Demonstrable means the proof comes from contemporaneous, tamper-proof records, not documents reconstructed before an audit.

Why “diligence” rather than “perfect compliance”?

Because perfect, permanent compliance does not exist with AI. The ecosystem changes weekly — often through vendors — and no text demands the impossible. What regulators assess is something else: did the organization know what it was running, look for its gaps, address them, and can it demonstrate all of that? Law 25 reasons this way for personal information; the AMF’s AI guideline and OSFI’s E-23, both in force May 1, 2027, phrase their expectations in the same register — maintained inventories, revisited risk ratings, ongoing monitoring.

What does the word “demonstrable” change?

Everything. Diligence that is real but undemonstrable carries no weight before a council, an auditor, or a regulator. Three requirements separate evidence that holds:

  • Contemporaneous. Recorded as things happen — not written the week before the examination. A reconstructed file shows one day’s state; it does not demonstrate a practice.
  • Tamper-proof. Evidence its author can rewrite is not evidence. That is what makes an append-only, hash-chained history held by an independent custodian credible.
  • Neutral. The record can show compliance or failure — which is exactly why it is believed. A gap detected, addressed, and recorded is a strength; it is blindness that costs.

Who is the demonstration for?

Regulators first — but not only. The municipal council, the board, the auditor, the insurer, and the lender all ask the same question in different words: “show us it is under control.” One record, if clean and continuous, answers all of them.
